Participant Waiver & Release
kefi collective LIABILITY WAIVER, ASSUMPTION OF RISK, AND RELEASE
This agreement is entered into between Kefi Collective LLC, (“Kefi Collective”), and the undersigned participant (“Participant”).
1. ASSUMPTION OF RISK
Cycling in Greece is rewarding. It also involves real and inherent risks. Participation in Kefi Collective journeys includes, but is not limited to:
- Riding on open roads alongside motor vehicle traffic, pedestrians, cyclists, and animals
- Variable road surfaces including paved and unpaved terrain, gravel, potholes, and debris
- Mechanical failure of bicycles or equipment, whether personal or rental
- Weather conditions including heat, rain, wind, lightning, and cold
- Altitude-related illness including hypoxia and pulmonary edema
- Physical exertion leading to exhaustion, dehydration, cardiac events, or injury
- Travel in remote or rural areas where medical care and evacuation may be delayed
- Exposure to communicable diseases including but not limited to COVID-19 and dengue
- Acts, errors, or omissions of third-party providers of lodging, transport, and meals
The Participant knowingly and voluntarily assumes all risks associated with participation, whether known or unknown, including those arising from ordinary negligence.
2. PARTICIPANT DECLARATIONS
By signing this agreement, the Participant confirms that:
- They are at least 18 years of age. Minors may participate only with prior written approval and a signed parent or guardian release.
- They are physically and mentally fit to participate in a multi-day cycling journey at altitude.
- They have accurately completed the confidential medical disclosure provided at booking and declared all relevant medical, dietary, and safety information.
- They are an experienced road cyclist who has ridden regularly on open roads in the twelve months prior to the journey.
- Their personal equipment is safe, appropriate, and in sound mechanical condition. Participants using rental equipment confirm they have inspected it and accept it in its current condition.
- They will comply with Greek traffic Code (Article 40 (General Rules & Conduct), Article 19 & 16 (Position on the Road), Article 59 & 76 (Brakes and Equipment) ), all guide instructions, and the no-alcohol and no-psychoactive-substances rule while riding.
- They will wear a helmet at all times while on the bicycle.
Misrepresentation of fitness, experience, or medical condition entitles Kefi Collective to remove the Participant from the journey without refund and releases Kefi Collective from any related claims.
3. RELEASE OF LIABILITY
To the fullest extent permitted by United States and Greek law, the Participant releases and discharges Kefi Collective LLC, its directors, employees, contractors, guides, partners, sponsors, and representatives from any and all liability, claims, or demands arising out of or related to participation in Kefi Collective journeys, including injury, illness, property loss, or death, whether arising from ordinary negligence or otherwise.
Nothing in this release limits liability for gross negligence (culpa grave), willful misconduct (dolo), or non-waivable rights under United States consumer law. Kefi Collective’s duty in emergencies is limited to reasonable efforts to arrange care and evacuation, not to guarantee outcomes or response times, particularly in remote areas. The presence of a support vehicle, guide, or mechanic does not eliminate the inherent risks of cycling.
4. INDEMNIFICATION
The Participant agrees to indemnify and hold harmless Kefi Collective from any claims, damages, losses, or expenses, including legal fees, arising from their participation or actions during the journey.
5. MEDICAL AUTHORIZATION AND INSURANCE
In the event of injury, illness, or emergency, the Participant authorizes Kefi Collective to arrange medical care and evacuation on their behalf. The Participant accepts full financial responsibility for all medical, transportation, and evacuation costs.
Kefi Collective does not provide medical insurance. Comprehensive travel and medical insurance covering cycling accidents, medical evacuation, and repatriation is required for participation.
6. DATA PROTECTION

Operational data. The Participant consents to the collection and processing of personal, contact, medical, and insurance data for the sole purpose of managing the journey, ensuring safety, and complying with legal obligations. Medical information is treated as confidential and destroyed within ninety days of journey completion. Other operational data is retained only as required by law.
Image and media consent. The Participant may separately consent to the use of photographs, video, and other media captured during the journey for editorial, marketing, and archival purposes. This consent is optional, revocable at any time in writing to mailto: info@keficollective.cc, and does not affect participation.
7. GOVERNING LAW, JURISDICTION, AND LANGUAGE
This agreement is governed by the laws of the State of Georgia and applicable federal laws of the United States. Any disputes shall be subject to the exclusive jurisdiction of the state or federal courts located in DeKalb County, Georgia. This agreement is provided in English.
8. ELECTRONIC SIGNATURE
The Participant agrees that an electronic signature carries the same legal effect as a handwritten signature under the (ESIGN) Act.
9. SEVERABILITY
If any provision of this agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
10. ACKNOWLEDGMENT
By signing, the Participant confirms that they have read, understood, and agree to this agreement voluntarily, and that it constitutes a complete and unconditional release of liability to the fullest extent permitted by law.
